Terms of service

Version 1.0 · operators

These terms govern access to this website and to the Polyvatic sandbox. Where you have signed a master services agreement with us, that agreement prevails over anything on this page.

Who we contract with

We contract with licensed operators and their corporate affiliates. We do not contract with, onboard or provide services to retail clients. If you are an individual trader, your relationship is with the operator whose venue you use, not with Polyvatic.

What we supply

Exchange technology, liquidity arrangement under a stated coverage schedule, and growth services. Each is scoped in an order form referencing the master agreement. Nothing on this website is an offer capable of acceptance.

Liquidity Coverage targets per named category and hours, contracted with a licensed market maker

Licences and permissions

You hold your own regulatory permissions. Polyvatic holds none, on your behalf or otherwise: we perform no licensed activity, do not quote prices and are not a counterparty to any trade. You are responsible for determining, with your own counsel, whether and how you may list any category of contract in any market you serve.

Sandbox access

Sandbox credentials are issued for evaluation, carry simulated market data only, and may be withdrawn at any time. You may not present sandbox output to any third party as a representation of live performance.

Service levels and remedies

Platform uptime and liquidity coverage targets, their measurement methods, exclusion windows and remedies are set out in your agreement. Where arranged coverage misses its targets, the stated remedy is a rebate of our platform fees against the published schedule. We do not warrant any level of traded volume, trader count or revenue.

Termination and run-off

Notice periods are stated in months in your agreement. On termination, trader records, balances and history export in a defined format, open contracts run off to resolution, and we take no exclusivity over your trader base at any point.

Liability

Liability is capped as stated in your agreement. Where a mis-resolution is caused by our misreading of a named settlement source, we make the affected book whole up to the cap stated in the resolution schedule.

Governing law

These terms and the master agreement are governed by the laws of the Hong Kong Special Administrative Region. The courts of Hong Kong have exclusive jurisdiction, and disputes may be referred to arbitration at the Hong Kong International Arbitration Centre where your order form provides for it.
